GMO LABELING UPDATE

I want to start by thanking you very much for taking the time to speak with us yesterday. It was an extremely busy day for us, so I can hardly imagine what it must have been like for you. That you took time out of your schedule to speak with us speaks volumes about your character as a public official and representative of the people of Hawai’i. I also want to take a moment to apologize, first for not getting this email to you yesterday, and secondly for not realizing that you were a Richardson graduate.

Per your request, please find attached materials concerning the constitutional issues surrounding HB 174, as well as a couple of pieces regarding GMO labeling bills more generally. While it’s a little late in the game for HB 174, this fight is far from over and I figure that these materials may come in handy in the future. Please find attached the following:

  • Constitutionality of HB174 Concerning Labeling–Paul Achitoff’s (Earthjustice) response memo tracking our own analysis but doing a better job (see, “Difference between a law student and lawyer” ;-))
  • 2012-12-07 GE Labeling Memo-ENRLC–A detailed memo of the constitutional issues surrounding GMO labeling, with particular focus on Vermont law
  • GE Labeling-Consistency Guidelines–A one page “cheat sheet” for how to construct labeling bills that will be constitutional
